This Privacy Policy explains how Wacky Wear Studio ("we", "us", "our") collects, uses and protects your personal information when you visit our website and place an order. We are the data controller for the information you provide. If you have any questions, contact us at info@wackywearstudio.com.

2. The information we collect

  • Order & contact details — name, email, delivery and billing address, phone number.
  • Photos you upload — the image of a person, child or pet that you provide so we can create your caricature, plus the caricature artwork we generate from it.
  • Payment information — processed securely by our payment provider (Shopify Payments and, where offered, Shop Pay / Apple Pay / PayPal). We do not see or store your full card details.
  • Account information — if you create an account (order history, saved details).
  • Usage & device data — cookies, IP address, browser/device type and how you use the site (see Cookies below).
  • Communications — messages you send us and your marketing preferences.

3. How we use your photos (AI caricature processing)

To create your caricature, the photo you upload is processed by automated image-generation tools provided by our third-party partners — our personalisation partner Teeinblue and a third-party AI image-generation provider (Google). Your photo and the resulting caricature are used only to produce, check and fulfil your order (including reprints or returns). A member of our team also reviews each caricature before printing.

By uploading a photo you confirm that you own it or have permission to use it, that everyone shown consents to its use, and that you are the parent/guardian of — or have the guardian's permission for — any child under 18 in the image. Please do not upload photos of other people without their permission.

4. Why we use your information (legal bases under UK GDPR)

  • To perform our contract with you — processing your photo, creating the caricature, taking payment, fulfilling and delivering your order, and handling returns.
  • Your consent — sending marketing emails (which you can withdraw at any time) and non-essential cookies.
  • Our legitimate interests — running and improving our shop, preventing fraud and keeping the site secure.
  • Legal obligations — keeping tax and transaction records.

5. Who we share it with

We share information only with service providers who help us run the shop, under contracts that require them to protect it:

  • Shopify — our e-commerce and checkout platform.
  • Teeinblue — personalisation / caricature preview.
  • Google — AI image generation for the caricature.
  • Printful — printing and fulfilment of your order.
  • Payment providers, and authorities/advisers where required by law.

Some of our providers may store or process data outside the UK. Where information is transferred internationally, we rely on appropriate safeguards such as UK-approved standard contractual clauses.

6. How long we keep it

We keep your uploaded photo and the caricature we create only as long as we need them to make and deliver your order and to handle any reprints or returns — normally 30 to 90 days after your order is fulfilled — after which they are deleted. We keep basic order and transaction records for longer where the law requires (for example, tax records for up to 6 years). If you have an account and choose to save a design for reorders, we keep it until you delete it or close your account.

7. Your rights

You have the right to access, correct, delete or restrict our use of your personal information, to object to processing, to data portability, and to withdraw consent at any time. To exercise any of these, email info@wackywearstudio.com. You also have the right to complain to the UK Information Commissioner's Office (ICO) at ico.org.uk.

8. Cookies

We use essential cookies to run the site and checkout, and — with your consent — analytics and marketing cookies to understand and improve your experience. You can manage your choices through our cookie banner or your browser settings.

9. Children

Our shop is intended for customers aged 18 and over. We knowingly process images of children only where the purchasing adult confirms they are the child's parent/guardian or have the guardian's permission.

10. Marketing

We'll only send you marketing emails if you've opted in. You can unsubscribe at any time via the link in any email or by contacting us.

11. Changes to this policy

We may update this policy from time to time. The "last updated" date shows when it last changed. Significant changes will be highlighted on this page.
